These Terms of Service ("Terms") govern your access to and use of the RescueIQ website and service (the "Service"). By accessing the site, submitting your details, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
The Service
RescueIQ helps home-service businesses recover missed-call leads by texting callers back, qualifying the lead, and notifying the business. Features, availability, and pricing may change as the Service evolves.
Eligibility and accounts
You must be at least 18 years old and able to enter into a contract to use the Service. If you create an account, you are responsible for the information you provide and for activity under your account, and you agree to keep your credentials secure.
Plans, trials, and billing
Pricing for the Service is shown on our website and may include introductory or founder pricing and a free trial. Paid subscriptions, when offered, are billed in advance on a recurring basis until cancelled. Any specific pricing, trial length, or grandfathering terms are those presented at the time you sign up. We will make billing terms clear before you are charged.
Communications consent
By providing your contact details, you agree that we may contact you about the Service by email, phone, or SMS. Message and data rates may apply to SMS. You may opt out of SMS by replying STOP and of other communications by contacting us. See our Privacy Policy for how we handle your information.
Acceptable use
You agree not to misuse the Service — including using it unlawfully, infringing others' rights, attempting to disrupt or gain unauthorized access to our systems, or using it to send unlawful or unsolicited messages. You are responsible for complying with laws that apply to your own communications with your customers, including applicable telemarketing and messaging regulations.
Intellectual property
The Service, including its software, content, and branding, is owned by RescueIQ and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You retain ownership of the data and content you provide.
Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that it will recover every lead or message.
Limitation of liability
To the fullest extent permitted by law, RescueIQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in North Carolina.
